Three questions decide it: the form, who the plaintiff would be, and where that person lives.
I take a defined set of federal delay cases and I take them in a defined set of districts. The form below checks those criteria before it asks for anything else, so that neither of us spends time on a case I cannot file. If your case fits, it then takes the facts that matter: the filing date and anything unusual about the case. There is no charge for the evaluation, and I am the one who reads it.
Forms: N-400 naturalization; I-485 adjustment of status; I-130 family petitions, standing alone or together with the I-129F / K-3 route described on the I-130 page; and I-129 or I-140 employment petitions where the petitioning employer is the plaintiff.
Districts: all four districts of New York; New Jersey; Connecticut; Colorado; the District of Columbia (D.C. residents); the Middle and Southern Districts of Florida; the Southern and Northern Districts of Texas. The district follows the residence of the person who would sue.
Not now: consular and visa-stamping delays, I-751, I-765, I-131, I-90, I-601A, N-600/N-600K, asylum, VAWA, SIJS, I-730, EB-5, PERM, DV and FOIA matters. Those pages stay on the site for information. Licensed attorneys with a case in any of these areas may use the co-counsel form; low-income applicants should read the pro bono program criteria.
JavaScript is required. Nothing on this page is sent to a third-party form provider; the inquiry goes to a sandboxed service on the firm’s own server and is read by the attorney. Attorney Advertising. Prior results do not guarantee a similar outcome.
I review the inquiry against the processing data I keep for the forms and offices I litigate, and I answer by email, normally within one business day. If the delay does not yet support a claim, I say so and tell you what would change the answer. If it does, I explain the fee, which is flat, and what I would need from you. Please do not send documents until I ask for them: unsolicited material is not reviewed, is not treated as confidential, and does not create an attorney-client relationship. No relationship exists unless and until a written engagement agreement is signed by both of us.
