Case summary: My client, a Green Card holder with a felony conviction, sought to become a naturalized U.S. citizen. He also had a pending I-130 petition in favor of his wife. USCIS refused to adjudicate either the citizenship application or the adjustment of status application of his wife, until we filed a Mandamus petition. Both applications were approved roughly 3 months later.

Rodriguez Dean v. Sessions 2:2018cv13030
Filed: 08/21/2018 Closed: 02/28/2019
Case summary: My client was placed in removal proceedings for having allegedly abandoned his LPR status by signing Form I-407. During his removal proceedings, I convinced the Immigration Court to dismiss the Notice to Appear and terminate proceedings. Yet, USCIS still refused to approve my client’s Form I-90. The USCIS approved the I-90 and produced a new Green Card roughly 5 months after we filed the Mandamus petition.

Case summary: My client’s I-485 application (which he had filed though another attorney) was denied for failure to timely respond to a Request For Evidence even though, during the COVID pandemic, USCIS had granted applicants additional time. We filed a Mandamus petition to force USCIS to adjudicate the I-485 application on the merits. Roughly 45 days after filing, USCIS reopened the case and issued a new RFE.
